Refund and Cancellation Policy

1. General Provisions

Proxy services offered by ProxyTurk are considered digital content and services under the Consumer Protection Law No. 6502 and the Distance Contracts Regulation. This policy determines the rights and obligations between the parties.

The user declares and undertakes that they have read, understood and accepted all the terms and conditions in this policy at the time of completing the service purchase.

2. Right of Withdrawal

In accordance with Article 48 of the Consumer Protection Law No. 6502 and Article 15/ğ of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services that are instantly performed in a digital environment and intangible goods that are instantly delivered in an electronic environment.

However, ProxyTurk, prioritizing customer satisfaction, offers refund and cancellation options under the following conditions.

3. Refund Conditions

3.1. 7-Day Refund Guarantee

ProxyTurk grants a refund right within 7 (seven) calendar days for first-time purchased services, provided all of the following conditions are met:

• The refund request must be made within 7 (seven) calendar days from service activation.
• The user must not have previously purchased and refunded the same service.
• Service usage must not have exceeded 10% of total capacity (including bandwidth, connection count, data transfer, etc.).
• It must be confirmed that the service has not been misused and the rights and interests of third parties have not been violated.
• The refund request must be submitted in writing to [email protected] or through the support system.

3.2. Cases Where Refund Will Not Be Made

Refund requests will not be accepted in the following cases:

• The 7-day refund period has expired
• The service has been previously purchased and refunded (recurring refund requests are not accepted)
• Service usage rate has exceeded 10%
• The user has violated service rules or terms of use
• The service has been used or attempted to be used for illegal purposes
• Services purchased at discounted, campaign or promotional prices (unless specifically stated otherwise)
• Issues caused by the user's own negligence, misconfiguration or third-party software
• The proxy service has been confirmed to work correctly technically but does not meet the user's expectations
• The user's account has been suspended or closed due to security breach, fraud or misuse

3.3. Partial Refund

In cases where the service has been partially used, ProxyTurk may, at its sole discretion, make a partial refund for the amount corresponding to the unused period. The partial refund amount is calculated taking into account the total duration of the service, the period used, resources consumed and transaction costs.

4. Refund Procedure

1. The user submits the refund request in writing to [email protected] or through the support system.
2. The request is evaluated by our technical team within the refund conditions framework within 3 (three) business days.
3. When the refund request is approved, the refund process is initiated to the payment method used.
4. Refunds for credit card payments are reflected in the account within 5-14 business days depending on the bank's processing time.
5. Refunds for bank transfer/EFT payments are made to the IBAN specified by the user within 5 business days.
6. When the refund process is completed, the related service is immediately terminated and all access credentials (proxy credentials) are disabled.

5. Service Cancellation

5.1. Cancellation by User

The user can cancel their active subscription at any time. The cancellation request takes effect at the end of the current payment period. No refund is made for the period up to the cancellation date. After cancellation, the service remains active until the end of the payment period.

5.2. Cancellation by ProxyTurk

ProxyTurk reserves the right to cancel the service without prior notice and to suspend or close the user account in the following cases:

• Violation of Terms of Use
• Use or attempted use of the service for illegal purposes
• Violation of third-party rights (copyright, personal data protection, intellectual property, etc.)
• Carrying out spam, phishing, DDoS attacks, hacking or similar malicious activities
• Fraud, fake identity usage or payment fraud
• Sharing the service with unauthorized third parties or sub-leasing
• Deliberately overloading or misusing the server infrastructure
• Due to legal regulations or requests from authorized authorities

In these cases, no refund is made and the user is obligated to compensate all direct and indirect damages (including litigation costs and attorney fees) incurred by ProxyTurk.

6. Limitation of Liability

The user uses ProxyTurk services under their own responsibility. All legal, criminal and administrative responsibility arising from the use of services belongs entirely to the user. ProxyTurk cannot be held responsible for any consequences arising from the user's use of services in an illegal, unlawful manner or in a way that violates the rights of third parties.

The user exempts ProxyTurk, its managers, employees and business partners from any third-party claims, lawsuits, complaints, administrative fines, judicial fines and similar sanctions arising from the use of ProxyTurk services, and accepts and undertakes to compensate all material and moral damages (including attorney fees, litigation costs, expert fees and compensation) that may arise in this context in a manner that can be recouped by ProxyTurk.

ProxyTurk's liability for indirect damages arising from service interruptions, data loss, connection issues or similar technical problems is in any case limited to the service fee paid by the user in the last 1 (one) month.

7. Force Majeure

In cases of force majeure such as natural disasters, war, terrorism, epidemics, strikes, lockouts, changes in legal regulations, internet infrastructure issues, data center failures, cyber attacks and similar situations beyond the control of the parties, ProxyTurk's obligations are suspended and refund requests are not evaluated during this period.

8. Dispute Resolution

In all disputes arising from or related to this policy, a solution will first be sought through reconciliation between the parties. If reconciliation cannot be achieved, Consumer Arbitration Committees and Consumer Courts have jurisdiction for disputes within the scope of Law No. 6502, and Kocaeli Courts and Enforcement Offices have jurisdiction for other disputes.

9. Changes

ProxyTurk reserves the right to change this refund and cancellation policy at any time without prior notice. The updated policy becomes effective from the moment it is published on the website. Users are advised to check the policy regularly.
