Terms of Use

1. Definitions

• "Service": All proxy services (ISP IPv4, IPv6, Mobile Proxy), website, API, control panel, support, and related software from ProxyTurk.
• "User": Any person or company that signs up for or uses the Service.
• "Content": Any data or material you send, receive, store, or process through the Service.
• "Proxy Credential": Your proxy login details: username, password, IP address, and port.
• "Account": Your registered account on the ProxyTurk platform.

2. Scope of Service

ProxyTurk offers the following services:

• ISP IPv4 Proxy services (Vodafone, Türk Telekom infrastructure)
• ISP IPv6 Proxy services
• Mobile Proxy services (3G/4G/5G)
• HTTP, HTTPS and SOCKS5 protocols
• Automatic IP rotation (mobile proxy)
• User control panel and API access
• 24/7 technical support

ProxyTurk may change the scope, features, prices, or infrastructure of the service at any time without prior notice.

3. Account Creation and Obligations

4. Acceptable Use Policy

4.1. Permitted Use

ProxyTurk services may only be used for legal purposes:

• Web scraping (provided it complies with the target site's terms of use)
• Social media account management
• SEO research and analysis
• Market research and price comparison
• Ad verification
• Accessing geo-restricted content
• Software testing and development
• Privacy and anonymity protection

4.2. Strictly Prohibited Uses

The following uses are strictly banned. If we find any of these, your account will be closed right away with no refund:

• Illegal activities: Hacking, unauthorized access, computer crimes, cyber attacks
• DDoS/DoS attacks: Launching or helping with attacks that overload any system
• Spam and bulk messaging: Sending unsolicited bulk emails, SMS or messages
• Phishing and fraud: Phishing, creating fake websites, financial fraud
• Malware: Spreading viruses, trojans, ransomware, or other harmful software
• Child exploitation: Any content and activity related to child pornography or child exploitation
• Copyright infringement: Unauthorized distribution or copying of copyrighted content
• Misuse of personal data: Collecting or sharing other people's personal data without their permission
• Illegal gambling: Operating or facilitating illegal gambling sites
• Drugs and illegal substances: Drug or illegal substance trafficking
• Terrorism-related activities: Promoting or supporting terrorist groups
• Hate speech: Hate speech and incitement to violence based on race, religion, gender, ethnicity or sexual orientation
• Unauthorized account creation: Use of automated or bulk account creation bots (without permission)
• Infrastructure abuse: Overloading our servers on purpose, port scanning, or looking for security holes
• Sub-leasing: Selling, renting or sharing proxy access credentials with third parties
• Fake identity: Using fake information or documents during registration or KYC process
• Attacks on government systems: Accessing or disrupting government IT systems without permission
• Crypto mining: Using the proxy infrastructure for cryptocurrency mining

4.3. Resource Usage Limits

Users cannot exceed the resource limits within their purchased package. In case of excessive usage:

• ProxyTurk may warn the user or temporarily restrict the service
• In case of repeated violations, the account may be suspended or closed
• Additional costs arising from excessive usage may be charged to the user

6. Intellectual Property Rights

All ProxyTurk content (website, software, API, logos, designs, text, and graphics) belongs to Centerium Bilişim Teknolojileri ve Danışmanlık Hizmetleri Ltd. Şti. It is protected by Turkish IP laws (No. 5846 and No. 6769) and international agreements.

• Do not copy, share, or publish our content without written permission.
• Reverse engineering, decompiling, or taking apart our software is strictly banned.
• The ProxyTurk brand and logo cannot be used without permission.

7. Liability and Warranty Limitation

7.1. Service Warranty

ProxyTurk provides services "as-is" and "as-available." We do not promise the service will always work without errors or be fully secure. We make no warranty for:

• Being fit for a specific use case
• Running without stops or errors
• Reaching certain speed or performance levels
• Working with all third-party websites or services
• IP addresses not being blocked on any platform

7.2. Limitation of Liability

ProxyTurk is not responsible for any damages from using or not being able to use the services. This includes lost revenue, lost profit, data loss, harm to reputation, and missed chances.

Our total liability is limited to the fees you paid in the last 3 months before the issue.

7.3. Uptime Guarantee

We aim for 99.9% uptime, but this is a target, not a guarantee. Planned maintenance and events beyond our control are not included. We will try to announce maintenance ahead of time.

8. User Responsibility, Indemnification and Recourse

You are fully responsible for how you use ProxyTurk services. This covers all legal, criminal, and financial matters.

You agree to:

• Follow Turkish law and international rules when using our services
• Not violate the rights of others
• Not use the proxy for illegal purposes
• Keep your registration details accurate and current
• Keep your account secure

If your use of our services causes any claim, lawsuit, fine, or cost against ProxyTurk or its team, you agree to cover all resulting damages. This includes legal fees, fines, and any other expenses. ProxyTurk can seek reimbursement from you for these costs.

This right to seek reimbursement continues even after you stop using our services, within legal time limits.

9. Account Suspension and Termination

9.1. ProxyTurk's Rights

We may suspend or close your account without warning if:

• You break any of these terms
• We suspect illegal activity
• You fail to pay
• Fraud or use of fake identity
• A legal authority requests it
• Your activity threatens our systems
• You violate someone else's rights
• We need to protect our business interests

9.2. Consequences of Account Closure

• All your proxy login details are turned off right away
• No refund is given if your account was closed for breaking these terms
• We keep data as required by law for the required period
• Any debts you owe to ProxyTurk still apply

10. Privacy

To learn how we collect, use, and protect your personal data, please read our Privacy Policy and Data Protection Notice pages. These are part of these Terms of Use.

11. Force Majeure

Force majeure includes events beyond our control: natural disasters, war, terrorism, pandemics, strikes, government actions, internet outages, data center failures, power cuts, and cyber attacks.

During a force majeure event, our duties are paused. If it lasts more than 30 days, either side can end the contract. In that case, we will refund fees for the unused service period.

12. Applicable Law and Dispute Resolution

These terms follow the laws of the Republic of Turkey.

If a dispute comes up, both sides will first try to resolve it through good-faith discussion. If that does not work:

• Consumer disputes go to Consumer Arbitration Committees or Consumer Courts under Law No. 6502, based on the amount.
• Commercial disputes are handled by Kocaeli Courts and Enforcement Offices.

13. Severability

If a court finds any part of these terms invalid, the rest still applies. The invalid part will be replaced with the closest valid version that matches what both sides intended.

14. Waiver

If we do not enforce a rule at some point, that does not mean we give up that right. We keep all our rights under these terms.

15. Assignment

You cannot transfer your rights or duties under these terms to someone else without our written consent. ProxyTurk can transfer its own rights and duties to third parties.

16. Amendments

We may update these terms at any time. For big changes, we will notify you by email or post a notice on our website.

New terms take effect as soon as they are posted. If you keep using our services after a change, you accept the new terms. If you disagree, stop using our services and close your account.

17. Entirety

These Terms of Use, together with the Privacy Policy, Data Protection Notice, Cookie Policy and Refund and Cancellation Policy, make up the full agreement between us. They replace all earlier written or spoken agreements.
